1. Scope and Intended Use

Ocean Efficiency ("the Service") provides planning tools for commercial maritime use, including geopolitical boundary overlays, sunrise/sunset timing, tidal data visualisation, route and rest-hour calculators, and voyage efficiency analysis. The Service is intended solely to assist mariners in making non-safety-critical commercial planning decisions and is provided by Tom Shelley ("the Operator").

2. Not for Primary Navigation

This Service must not be used as a primary or sole source for navigation, route approval, collision avoidance, or regulatory compliance. Users must consult official, flag-state-approved publications (e.g. Admiralty charts, Total Tide, Notices to Mariners) and reputable commercial or governmental services for all voyage-critical and safety-of-life decisions. No output of this Service replaces the professional judgement of a qualified deck officer or pilot.

3. Disclaimer of Warranties

The Service and all data, calculations, and outputs are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, the Operator disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement. No information or advice, whether oral or written, obtained from the Service shall create any warranty not expressly stated herein.

4. Data Accuracy and Reliability
  • Every reasonable effort has been made to ensure data reliability and accuracy; however, no guarantee is made regarding the completeness, precision, timeliness, or correctness of any data, calculation, or output.
  • Tidal predictions, solar calculations, weather data, geopolitical boundaries, and depth information may contain errors, may be outdated, or may not reflect real-time conditions.
  • All information must be independently verified against official sources or validated with recognised third-party systems before being relied upon.
5. Limitation of Liability

To the maximum extent permitted by law, in no event shall the Operator, its affiliates, data providers, or any third-party service providers be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of life or personal injury arising from navigational reliance; grounding, collision, or any maritime incident; commercial losses, lost profits, or business interruption; loss of data; or any other damages arising out of or in connection with the use of, inability to use, or reliance upon the Service or its outputs, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if the Operator has been advised of the possibility of such damages.

If, notwithstanding the foregoing, the Operator is found liable, total aggregate liability shall not exceed the greater of (a) the fees actually paid by you for the Service in the twelve (12) months preceding the claim, or (b) fifty pounds sterling (£50).

6. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) any navigational, operational, or commercial decision made in reliance on the Service; (c) your breach of these Terms; or (d) your violation of any applicable law or regulation.

7. Licence Grant and Intellectual Property
  • A limited, non-exclusive, non-transferable, revocable licence is granted to use the Service for lawful, professional planning purposes.
  • All intellectual property rights in the Service, including its design, code, algorithms, and content, remain the exclusive property of the Operator.
  • You may not reverse-engineer, decompile, copy, redistribute, sublicence, or integrate this Service or any of its outputs into third-party products without explicit written permission.
8. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you become aware of any unauthorised use. The Operator is not liable for any loss arising from unauthorised access to your account.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable maritime or domestic law;
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems;
  • Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service without written permission;
  • Interfere with or disrupt the integrity or performance of the Service.
10. Privacy and Data Collection

When you use the Service, we collect and process the following data:

  • Account data: username, email address, and a securely hashed password.
  • Usage data: login timestamps, session tokens, and login frequency.
  • Content you create: voyages, routes, waypoint coordinates, tidal data, and associated planning data.

Your data is stored in a secured database and is used solely to provide and improve the Service. We do not sell, rent, or share your personal data with third parties for marketing purposes. Account data is retained for as long as your account is active. You may request deletion of your account and associated data by contacting [email protected].

11. Third-Party Services

The Service integrates with third-party APIs to provide certain features. When you use these features, limited data (such as geographic coordinates) may be transmitted to the following providers:

  • TimezoneDB — timezone lookups based on coordinates;
  • OpenWeatherMap — weather forecast data;
  • WorldTides.info — tidal height predictions;
  • SHOM (French Hydrographic Office) — tidal water-level data;
  • Google reCAPTCHA — spam prevention during registration and contact form submissions (subject to Google's Privacy Policy and Terms of Service).

These providers operate under their own privacy policies and terms of service. The Operator is not responsible for the data practices of third-party providers.

12. Cookies and Sessions

The Service uses essential cookies and browser session storage to manage authentication and maintain your logged-in state. These are strictly necessary for the Service to function and cannot be disabled. No advertising or tracking cookies are used.

13. Updates and Modifications

The Operator reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice or liability. These Terms may be updated from time to time; the "Effective Date" above will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Termination

Access may be suspended or revoked at any time at the Operator's sole discretion, including for abuse, misuse, or non-compliance with these Terms. Upon termination, your right to use the Service ceases immediately. Sections 3, 5, 6, 7, and 15 survive termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with any documents expressly referred to herein, constitute the entire agreement between you and the Operator regarding the Service, and supersede all prior agreements, understandings, or representations.
